We're a small team working on bringing the art and science of surfboard design into the modern era. After working with technologies in different industries, it became clear that shapers were being forced to use outdated tools.

Tom is from a coastal town on Australia's East coast where he grew up surfing every day. He's led engineering teams at VC-funded startups after achieving first class honours in computer and software engineering. SurfStudio was born from his passion for surfing and building high quality, cutting-edge technology whilst working alongside the best in the industry.

Mike's experience in the surfboard industry is unrivalled, inventing and manufacturing the most advanced, high quality, machines in the world at SurfShaper, ex AkuShaper Australia. He brings a wealth of insight to the whole product and has made certain the cuts coming out of SurfStudio are spot on. Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the SurfStudio surfboard design software, websites, and related services (together, the "Service"), provided by SurfStudio ("we", "our", or "us"). By creating an account, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old and able to form a legally binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorised to bind that business to these Terms.

3. Licence to Use the Software

Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the software for your own surfboard design and machining purposes. Licences may be tied to a specific device to enable offline use. You may not sublicense, resell, rent, or share your licence with others.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorised use. You must provide accurate account information and keep it up to date.

5. Subscriptions, Billing and Payments

  • Paid plans are billed in advance on a recurring basis (e.g. monthly or annually) through our payment provider.
  • Subscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period.
  • Fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes, including GST where required.
  • Except where required by law, payments are non-refundable. We may change our pricing on reasonable notice, effective from your next billing period.

6. Your Content and Intellectual Property

You retain 100% ownership of the surfboard designs, models, and project files you create using the Service ("Your Content"). We claim no intellectual property rights over Your Content. You grant us a limited licence to store and process Your Content solely to provide the Service to you.

7. Our Intellectual Property

The Service, including its software, design tools, branding, and content (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except the limited licence described above.

8. Acceptable Use

You agree not to:

  • Copy, modify, reverse engineer, or attempt to extract the source code of the Service, except to the extent permitted by law;
  • Circumvent licensing, security, or usage limitations;
  • Use the Service to infringe the rights of others or for any unlawful purpose;
  • Interfere with or disrupt the integrity or performance of the Service.

9. Third-Party Services

The Service relies on third-party providers (such as cloud hosting, payment processing, and analytics). Your use of those services may be subject to their own terms. We are not responsible for third-party services beyond our reasonable control.

10. CNC Machining and Safety

The Service generates designs and G-code intended for use with CNC machinery. You are solely responsible for reviewing and validating all outputs before machining, and for the safe operation of your equipment. We do not guarantee that generated toolpaths are suitable for any particular machine, material, or purpose, and we accept no liability for damage, injury, or loss arising from their use.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded, including under the Australian Consumer Law.

12. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from your use of the Service, Your Content, or your breach of these Terms.

14. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or if required to protect the Service or other users. On termination, your licence ends and you must stop using the software. Sections that by their nature should survive termination will continue to apply.

15. Changes to the Service and Terms

We may modify or discontinue features of the Service, and we may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of the courts of Australia, without limiting any mandatory consumer protections that apply in your place of residence.
